The Sitota Collection and other marks indicated on our website are trademarks or registered trademarks of The Sitota Collection or its subsidiaries in the United States and/or other jurisdictions. The Sitota Collection’s graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of The Sitota Collection. The Sitota Collection trademarks and trade dress may not be used in connection with any product or service that is not The Sitota Collections in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits The Sitota Collection. All other trademarks not owned by The Sitota Collection that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by The Sitota Collection.

THE SITOTA COLLECTION CONTRACT
When you place an order to purchase a product from The Sitota Collection, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we dispatch that product to you and is confirmed by an email we send to you confirming that we have dispatched the product (the ‘Dispatch Confirmation E-mail’). That acceptance will be complete at the time we send the Dispatch Confirmation Email to you. Any products on the same order which we have not confirmed in a Dispatch Confirmation Email to have been dispatched do not form part of that contract. You are seeking to enter into a contract with The Sitota Collection when you place an order.

LIABILITY & WARRANTY
The Sitota Collection, its subsidiaries, its affiliates or its content suppliers do not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information or materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors to the fullest extent permitted by law.
Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

AVAILABILITY
We list availability information for products sold by us on the website, Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will inform you by email if any products you order turn out to be unavailable.

Although The Sitota Collection has made every effort to display our products and their colors as accurately as possible, the displayed colors of the products depend upon the monitor of the user, and The Sitota Collection cannot guarantee that the user’s monitor will accurately portray the actual colors of the products. Products displayed may be out-of-stock or discontinued, and prices are subject to change. The Sitota Collection is not responsible for typographical errors regarding price or any other matter.
Children
The Sitota Collection does not sell products for purchase by children. If you are under 18, you may use the website only with the involvement of a parent or guardian.

DISPUTES

However, if you have in any manner violated or threatened to violate any The Sitota Collection Intellectual Property right, we may seek injunctive or other appropriate relief in any state or federal court in the state of California. You consent to exclusive jurisdiction and venue in these courts. Any arbitration under this agreement and these Terms shall be conducted under the prevailing rules of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, we agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

GENERAL INFORMATION
These Terms constitute the entire agreement between you and The Sitota Collection and govern your use of the Site, and they supersede any prior agreements between you and The Sitota Collection. You also may be subject to additional terms and conditions that are applicable to certain parts of the Site. The Sitota Collection may terminate this Agreement and deny you access to the Site at any time, immediately and without notice, if in The Sitota Collection’s sole discretion you fail to comply with any provision of these Terms.
You agree that no joint venture, partnership, employment, or agency relationship exists between The Sitota Collection and you as a result of this Agreement or your use of the Site.
Any claim or cause of action you may have with respect to The Sitota Collection or the Site must be commenced within one (1) year after the claim or cause of action arose.
The failure of The Sitota Collection to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. The invalidity of any term, condition or provision in these Terms shall not affect the enforceability of those portions of the Terms deemed enforceable by applicable courts of law.
These Terms shall be governed by, construed and enforced in accordance with the laws of the State of California, without giving effect to any conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively by an appropriate federal or state court sitting in the State of California.
You may not assign the Terms or any of your rights or obligations under the Terms without The Sitota Collections expresses written consent. The Terms inure to the benefit of The Sitota Collections successors, assigns and licensees. The section titles in these Terms are for convenience only and have no legal or contractual effect.
